1. Acceptance of Terms

By creating an account, accessing the Platform, listing a space, placing a booking, or using any service offered by Airspaces (Pty) Ltd (“Airspaces”, “we”, “us”, “our”), you confirm that you have read, understood and agree to be legally bound by:

  • These Terms & Conditions
  • The Host Agreement & Listing Rules (if you are a Host)
  • The Guest Booking & Use Agreement (if you are a Guest)
  • The Marketplace Liability & Risk Waiver
  • The Cancellation & Refund Policy
  • The Community & Conduct Policy
  • The Hosting Responsibly Standards
  • The Privacy Policy (POPIA Compliant)
  • The Cookies Policy

By signing up, you expressly acknowledge that you have read, understood and accept all documents and policies published on the Airspaces website.

If you do not agree, you may not use the Platform.

2. Role of Airspaces

Airspaces is a digital marketplace that facilitates communication and secure transactions between Hosts who list spaces and Guests who book them.

Airspaces is not a landlord, property manager, venue operator, host, employer, agent, contractor, event coordinator, accommodation provider, or service provider.

All use of a space occurs under a direct contractual relationship between Host and Guest.

3. User Eligibility

  • You must be 18 years or older to use the Platform.
  • You agree to provide accurate and truthful information.
  • You are responsible for all activity conducted under your account.

4. Payments & Payouts

  • Guests pay Airspaces at the time of booking.
  • Airspaces pays Hosts after bookings conclude, less applicable service fees and deductions.
  • Airspaces may withhold or delay payouts where necessary for dispute resolution, fraud prevention, legal compliance or investigation.

5. Host Responsibilities

Hosts accept full financial and legal responsibility for:

  • The condition, legality and safety of the space
  • Compliance with zoning, licensing, health & safety, and occupancy regulations
  • Obtaining and maintaining appropriate insurance

Airspaces does not provide insurance or safety guarantees.

6. Guest Responsibilities

Guests agree to:

  • Use the space respectfully and lawfully
  • Follow all Host rules and building instructions
  • Accept financial responsibility for any damage, loss, theft, disturbance or misconduct caused

7. Liability & Risk Waiver

By using the Platform and/or entering any listed space, you voluntarily assume all risk of:

  • Injury or accident
  • Property damage or loss
  • Illness, harm or death
  • Third-party conduct or negligence

You irrevocably waive and release Airspaces from any claim, legal action, liability, damages, expenses or losses of any kind.

8. Cancellation & Refund Policy

All bookings are strictly non-refundable unless the Host cancels or accepts to waive the fee.

No refunds apply to:

  • No-shows
  • Guest cancellations at any time
  • Early departures or shortened stays
  • Guest dissatisfaction due to misunderstanding or personal expectation

9. Conduct Rules & Enforcement

Airspaces may suspend, restrict, cancel or terminate any account, booking or payout at its sole discretion where:

  • Misconduct occurs
  • Rules are violated
  • Safety concerns arise
  • Fraud or illegal activity is suspected

Airspaces’ decisions are final.

10. Governing Law

This Agreement is governed by the laws of the Republic of South Africa.

11. Acceptance

By signing up, you confirm that you have read, understood and voluntarily accept all Terms, Policies and Liability Waivers published on the Airspaces platform.

You agree that this acceptance is legally binding and enforceable in court.
