1. Scope and Applicability
This Cancellation & Refund Policy governs all cancellations, refunds, and refund-related disputes arising from bookings made through the Airspaces platform (“Platform”).
By completing a booking, the Guest irrevocably agrees to the cancellation and refund terms applicable to the listing at the time of booking, as determined by the Platform.
2. Standardised Cancellation Policies
Airspaces operates on a standardised cancellation framework. Refund percentages are system-defined and fixed per policy type.
Hosts are expressly prohibited from customising or altering refund percentages.
Refunds are calculated automatically by the Platform based on:
The cancellation policy selected for the listing
The time elapsed since booking
The time remaining before the scheduled check-in date
3. Cancellation Policy Types
3.1 Strict Policy
Where a listing is subject to a Strict cancellation policy:
A 100% refund applies if cancellation occurs within 24 hours of booking
A 50% refund applies if cancellation occurs seven (7) days or more prior to check-in
No refund applies in all other circumstances
3.2 Moderate Policy
Where a listing is subject to a Moderate cancellation policy:
A 100% refund applies if cancellation occurs within forty-eight (48) hours of booking, or fourteen (14) days or more prior to check-in
A 50% refund applies if cancellation occurs seven (7) days or more prior to check-in
No refund applies in all other circumstances
3.3 Flexible Policy
Where a listing is subject to a Flexible cancellation policy:
A 100% refund applies if cancellation occurs within forty-eight (48) hours of booking, or fourteen (14) days or more prior to check-in
A 50% refund applies if cancellation occurs seven (7) days or more prior to check-in
A 25% refund applies if cancellation occurs twenty-four (24) hours or more prior to check-in
No refund applies in all other circumstances
4. No Cancellation Policy
Where a Host selects a No Cancellation Policy:
The booking is non-refundable
No automatic refund entitlement arises
Any refund granted is entirely discretionary and subject to approval by Airspaces administration
5. Host Policy Selection and Disclosure
Hosts may select only one of the following policy types:
Strict
Moderate
Flexible
No Cancellation Policy
Hosts may include supplementary descriptive text for informational purposes only
Such text does not modify, override, or replace the Platform’s refund calculations
In the event of any inconsistency, system-calculated refunds prevail
6. Fees and Deductions
Platform service fees, payment gateway fees, banking fees, and third-party charges may be non-refundable
Refunds, where applicable, are processed to the original payment method
Processing timelines are subject to banking institutions and are outside Airspaces’ control
7. Administrative Override
Airspaces reserves the unrestricted right, at its sole and absolute discretion, to:
Override any automatically calculated refund amount
Approve partial refunds, full refunds, alternative compensation, or deny refunds entirely
Resolve refund requests in circumstances including but not limited to:
System or pricing errors
Verified disputes
Fraud prevention or compliance obligations
Force majeure events
Platform risk management considerations
All administrative decisions are final and binding.
8. Host-Initiated Cancellations
Where a Host cancels a confirmed booking:
Airspaces may issue a full refund to the Guest
Additional remedies, penalties, or account actions may be imposed on the Host
Repeated cancellations may result in suspension or termination of the Host account
9. Limitation, Waiver, and Finality
To the fullest extent permitted by law:
Guests and Hosts waive any claim against Airspaces arising from dissatisfaction with cancellation outcomes calculated in accordance with this Policy
Airspaces acts as a facilitating platform only and is not a party to the agreement between Host and Guest
Refund determinations made by the Platform or by Airspaces administration constitute full and final settlement
No oral representation, external communication, or Host-provided assurance shall give rise to a refund entitlement beyond what is expressly stated herein
Chargebacks, reversals, or payment disputes initiated outside the Platform may result in account suspension and recovery actions
10. Force Majeure, Infrastructure Failures, and Public Authority Actions
10.1 Definition of Force Majeure
Force Majeure includes any event or circumstance beyond the reasonable control of Airspaces, the Host, or the Guest, including but not limited to:
National, provincial, or municipal government actions, regulations, or shutdowns
Load shedding, extended power outages, electrical infrastructure failures, or grid instability
Water supply interruptions, sanitation failures, or municipal service disruptions
Civil unrest, strikes, protests, or public disorder
Natural disasters, extreme weather events, or acts of God
Epidemics, pandemics, or public health restrictions
Event cancellations mandated by public authorities
10.2 Effect of Force Majeure on Bookings
Where a booking is affected by a Force Majeure event:
Performance obligations may be suspended or rendered impossible
Neither Airspaces nor the Host shall be deemed in breach of contract
No automatic right to cancellation or refund arises solely due to the occurrence of a Force Majeure event
10.3 Refunds Under Force Majeure
Refund eligibility remains subject to:
The listing’s selected cancellation policy
The Platform’s system-calculated refund rules
Administrative review and approval
Airspaces may, at its sole discretion, approve partial or full refunds where fairness, feasibility, or legal compliance so requires
Platform fees and third-party charges may remain non-refundable, even in Force Majeure scenarios
10.4 Event-Specific and Infrastructure-Dependent Listings
Guests acknowledge and accept that event venues, pop-up locations, and infrastructure-dependent spaces may be affected by power outages, municipal shutdowns, or regulatory suspensions.
Such risks are inherent to these bookings and do not constitute misrepresentation by Airspaces.
11. Consumer Protection Act (CPA) Compliance
11.1 CPA Acknowledgement
Nothing in this Policy is intended to unlawfully limit or exclude rights afforded to consumers under the Consumer Protection Act, 68 of 2008, where applicable.
11.2 Fixed-Date and Fixed-Period Services
Bookings on Airspaces constitute fixed-date or fixed-period services.
Cancellations may be subject to reasonable cancellation charges as contemplated under Section 17 of the Consumer Protection Act.
The Platform’s fixed refund percentages constitute pre-agreed reasonable charges, taking into account:
Time of cancellation
Likelihood of re-booking
Administrative and operational costs
Host reliance and opportunity cost
11.3 No Double Recovery
Guests are not entitled to refunds beyond those calculated by the Platform or to concurrent relief under both Platform policies and statutory remedies for the same cancellation event.
11.4 Platform Facilitation Clarification
For Consumer Protection Act purposes:
Airspaces operates as an intermediary digital marketplace
The primary service provider remains the Host
Airspaces does not take possession, control, or occupation of listed spaces
11.5 Fairness and Discretion
Where fairness or reasonableness is required by law:
Airspaces’ administrative override powers shall be exercised to ensure compliance
Any refund granted beyond system rules does not constitute a precedent or waiver of rights
12. Risk Allocation and Assumption of Known Conditions
Guests expressly acknowledge and accept that:
Power outages, load shedding, and municipal service disruptions are known operational conditions in South Africa
Bookings are made with awareness of such risks
These conditions alone do not guarantee refunds or compensation
13. Governing Version
The version of this Cancellation & Refund Policy in force at the time of booking confirmation shall apply to that booking, irrespective of subsequent amendments.
